Welsh Language & Third Sector Organisations Responsibilities


The Welsh Language Commissioner and the Third Sector

Many have been asking what are the possible effects that change in legislation will have on the third sector in Wales.

The Welsh Language (Wales) Measure 2011:-
 Gives the Welsh language official status in Wales
 Establishes the role of the Welsh Language Commissioner.
 Makes provision about standards relating to the Welsh language.
Welsh Ministers are in the process of drafting the standards, and they are expected to be in place by the end of 2014. In due course these standards will replace statutory Welsh language schemes. How will standards affect the third sector?

The Welsh Language Commissioner recognizes the third sector’s role in promoting and facilitating the Welsh language. Third sector organizations often work directly with the public therefore it’s vitally important that they offer bilingual services in order to communicate effectively with the public. Some third sector organizations are named in the Measure as bodies which will have to comply with standards. Other third sector organizations will have to comply due to the fact they are receiving over £400,000 of public Money, or if they are acting on behalf of another organization which has to comply with standards. Traditionally, third sector organizations are innovative in indentifying their service users’ needs and operating inclusively. Many third sector organizations operate bilingually even though there is no legislative pressure on them to do so. They understand that there are many advantages to offering bilingual services.

 It conforms to their national identity
 It’s good practice
 They want to provide a Welsh language service in order to respect the user’s language choice

As more Welsh speakers feel confident in asking for Welsh medium Services, there will be increasing pressure on organizations to provide bilingual services. The Welsh Language Commissioner aims to promote the third sector’s voluntarily use of the Welsh Language and to encourage Welsh speakers to make use of those services. The Commissioner will need to complete a gap analysis to gain a better understanding of any support that the sector might need. The Welsh Language Commissioner is eager to work in partnership to avoid duplicating work in a difficult economical climate. The Commissioner will also provide training for organizations to prepare them for the change in legislation.

The Commissioner’s third sector unit is in the process of preparing a work plan which will demonstrate how the Welsh Language Commissioner intends to work with the third sector in Wales 2013- 2015. The Commissioner is eager to gain responses to the work plan, and will be advertising how you can have your say on its contents in a future issue of Network.


Comisiynydd y Gymraeg a’r Trydydd Sector

Bu sawl un yn gofyn am effaith posibl Mesur y Gymraeg (Cymru) 2011 ar y trydydd sector yng Nghymru. Yn gyffredinol, mae’r Mesur yn:-
 Cadarnhau statws y Gymraeg fel iaith swyddogol yng Nghymru
 Sefydlu swydd Comisiynydd y Gymraeg
 Creu trefn o gyflwyno dyletswyddau ar ffurf safonau



Mae Llywodraeth Cymru yn y broses o lunio safonau. Mae disgwyl i’r safonau ddod yn statudol ddiwedd 2014. Dros amser fe fydd y safonau hyn yn disodli cynlluniau iaith statudol.

Sut mae hyn am effeithio’r trydydd sector?

Mae’r Comisiynydd yn cydnabod pwysigrwydd y trydydd sector wrth hybu a hwyluso’r Gymraeg. Mae sefydliadau’r trydydd sector yn aml iawn yn gweithio’n uniongyrchol gyda’r cyhoedd felly mae’n hanfodol bwysig eu bod yn cynnig gwasanaethau dwyieithog er mwyn cyfathrebu’n effeithiol a’r cyhoedd.
Caiff rhai mudiadau trydydd sector eu henwi yn y Mesur fel sefydliadau y bydd disgwyl iddynt gydymffurfio â’r safonau. Bydd angen i sefydliadau eraill gydymffurfio â gofynion fel amod derbyn arian cyhoeddus o dros £400,000 neu wrth weithredu ar ran sefydliad sy’n gymwys i gydymffurfio â safonau.

Yn draddodiadol, mae’r trydydd sector yn arloesi o safbwynt deall anghenion eu defnyddwyr a gweithredu’n gynhwysol. Golyga hyn fod nifer o sefydliadau eisoes yn cynnig gwasanaethau Cymraeg er nad oes gorfodaeth statudol arnynt i wneud hynny. Deallent fod llawer o fanteision dros gynnig gwasanaethau dwyieithog:
 Mae’n cyd-fynd a’u hunaniaeth
 Gall fod yn fanteisiol wrth godi arian
 Maent o’r farn ei fod yn arfer da
 Gall fod yn fanteisiol wrth lobio gwneuthurwyr polisi
 Maent eisiau darparu gwasanaethau Cymraeg sydd yn parchu dewis iaith y defnyddiwr

Wrth i siaradwyr Cymraeg ddod yn fwy hyderus i ofyn am wasanaethau dwyieithog, bydd pwysau cynyddol ar sefydliadau i ddarparu gwasanaethau dwyieithog. Bwriad Comisiynydd y Gymraeg yw hybu defnydd gwirfoddol y trydydd sector o’r Gymraeg ac annog siaradwyr Cymraeg i fanteisio ar y gwasanaethau hynny. Er mwyn gwneud hyn fe fydd yn rhaid adnabod bylchau i ennyn gwell dealltwriaeth o’r cymorth sydd ei angen ar y sector.

Mae Comisiynydd y Gymraeg yn awyddus iawn i gydweithio â phartneriaid i osgoi dyblygu gwaith mewn cyfnod economaidd anodd ac i wrando ar anghenion y sector. Rhan o waith y Comisiynydd yw trefnu hyfforddiant i sefydliadau er mwyn eu paratoi ar gyfer y newid mewn deddfwriaeth. Dros y misoedd nesaf mae uned trydydd sector Comisiynydd y Gymraeg yn paratoi ac yn ymgynghori ar raglen waith fydd yn manylu yn union sut fydd y Comisiynydd yn ymwneud â’r trydydd sector yng Nghymru rhwng 2013-15. Mae’r Comisiynydd yn awyddus iawn i dderbyn eich sylwadau ar y rhaglen waith, a byddwn yn hysbysebu sut gallwch leisio eich barn mewn rhifyn o Rhwydwaith yn y dyfodol.
